Firma digital en actos notariales, un reto para Costa Rica

Abstract

Notarial Law being one of the oldest branches of law, it is necessary to delve into its study and understand where it arises, as well as its purpose. Being then the Notaries so old, it is necessary to study about it, its impact and the need to intertwine it with social and technological advances, so that it has a positive effect on society and on its own actions. Society has been advanced and notarization has, in a certain way, been modernized, however, at the country level there is not such an advanced digitization that allows all notarial actions to be carried out through digitalization and certified or authenticated with these same means, that is, the implementation of laws such as 8454 has become obsolete due to the lack of incorporating technological methods that validate the information that is impregnated on paper. There exists abroad, within the framework of comparative law and in this legal field,
a great advance regarding the digitization of notarial acts or documents issued by notaries public, so Costa Rica should implement these mechanisms, embrace and make some of the characteristics of the Notary Public or the exercise of the notarial function abroad, in order to progress and advance as a society, in addition to becoming aware of the great contribution that would be generated to the environment with the reduction of physical documentation and maximization of digital documentation, duly signed and validated. It is because of the above that the need arises to study what the Notary Public confers and the application of
the digital signature, in order to intertwine or link the issues and then achieve a positive application of the advances that technology presents.
