Resumen

Los criterios Ambientales, Sociales y de Gobernanza son un grupo de reglas a seguir en el sector empresarial y de inversión en general. Básicamente, los criterios ASG han trazado la ruta por la cual las compañías desarrollan sus modelos de negocio y prácticas comerciales, velando por el cumplimiento de compromisos internacionales en cuanto a la protección del ambiente y a la regulación de emisiones de carbono se refiere; lo que genera el cambio de pautas corporativas que ocasionan disputas por someter a arbitraje comercial internacional. De igual manera, los criterios ASG, aportan elementos protagónicos en disputas de arbitraje de inversión entre un Estado y un inversionista que alega cambios a las condiciones de su inversión producto de nuevas políticas ambientales y la introducción de agendas de sostenibilidad, que perjudican sus operaciones tradicionales, amparadas bajo un Tratado o Acuerdo de Protección a las Inversiones.
